This letter is the Attorney General's order on your petition for disclosure of records
under the Oregon Public Records Law, ORS 192.410 to 192.505. Your letter, which was
addressed to James Toews, Office of Developmental Disabilities Services Division and copied
to the Attorney General, was received by our office on November 24, 1998. You requested
the Mental Health and Developmental Disability Services Division (MHDDSD) to provide
a list of the providers who were awarded programs under [the Fairview] RFP,
including the ranking of providers if more than one responded for any project
Your letter did not specifically request a public records order, however, we have
treated it as such as you alleged in your letter that MHDDSD has failed to produce the
requested records on three different occasions.
We have been informed by Jack Morgan, Deputy Administrator of the MHDDSD
Office of Developmental Disabilities Services, that the information you requested had
previously been faxed to you. Nonetheless, the Division will provide to you the information

you requested no later than December 15, 1998. Because the Division is providing the
requested information to you, we deny your petition as moot.
